Terms & Conditions for Buzzed Up E Bikes

By purchasing an E-bike from Buzzed Up E Bikes, you hereby accept and agree to all our Terms and Conditions. Please carefully read through all provided information thoroughly to fully comprehend our terms and conditions.

Returns & Refunds

Buzzed Up E Bikes are so confident in our products that we offer a 14-day guarantee. This means you have 14 days to return an item from the date you have received it.

To be eligible for a refund:

  • The item must be unused, unopened, unassembled, and in the same condition you received it.

  • The item must be in its original packaging.

  • Changes of mind are not applicable under this guarantee.

When Our Guarantee is Not Applicable:

  • Products that have been opened or tampered with in any way.

  • Products that are not in original packaging, or where the original packaging has been damaged.

  • External matters outside of our control, such as freight/shipping issues, natural disasters, Acts of God, or personal issues of the purchaser and/or their family.

  • Issues not relevant to the warranty, such as the quality or performance of the item.

  • Changes of mind.

  • Items returned to us outside of 14 days from the purchaser receiving the item.

Our Return Process:

  • We coordinate the return of the unit to our facility and inspect the product for damage. This is a labor-intensive process.

  • Whether or not we accept the return, we do not charge customers a fee for processing their request.

  • Shipping, taxes, and restocking fees are charged to the customer if you decide to return your E-bike.

  • We strongly advise you to use a trackable shipping service with shipping insurance. We are not liable for any items that are lost or damaged upon return to us.

Terms and Conditions for Returns:

  • You must be the original purchaser.

  • You must have the original proof of purchase receipt.

  • The product must have been purchased through our website or in our store directly.

  • The item must be returned unopened, unassembled, unused, and in its original, undamaged packaging, within 14 days of receiving the item.

  • Demonstrator or sale bikes are excluded from returns.

Once your item has been received and inspected at our facility, we will notify you as soon as possible of the outcome. Receipt of an application for a return request is not acknowledgment of approval. Buzzed Up E Bikes reserves the right to deny any return request at our discretion.

Restocking and Shipping Fees:

  • A restocking fee of 15% is charged for eligible returns. Typically, you will receive a refund of 85% of the cost of the product.

  • Your refund may also be subject to shipping costs, transaction fees, or any other fees required to complete the return.

Refunds:

  • If your return is approved, we will refund the amount to your original method of payment.

  • The time for cleared payments depends on the payment method used and your financial institution.

  • Refunds are not applicable for change of mind purchases.

Deposits

Deposits on electric dirt bikes are nonrefundable. By paying a deposit, you agree to enter into a legally binding agreement to purchase from Buzzed Up E Bikes. You cannot cancel this agreement or receive a refund.

Exchanges

We only offer exchanges on items deemed defective and non-repairable. We cannot exchange or refund on a change of mind basis. Please refer to our Warranty section for more details.

Delivery Times

Depending on your location, we use a number of different courier/freight/shipping companies. Due to matters outside of their and our control, we cannot guarantee delivery timeframes. We can guarantee we have a commitment to getting your newest obsession to you ASAP!

Bike Use Waiver & Release

The risk of injury from the use of any electric dirt bike could be significant, including the potential of permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce this risk, the possibility of serious injury while operating an electric dirt bike does exist. When buying from Buzzed Up E Bikes, the purchaser, including heirs, assigns, administrators, executors, and next of kin, waive all claims of damage, injuries, and death sustained to person or property that they may have against the aforementioned released party to such activities, including claims in tort, contract, equity, or otherwise.

Buzzed Up E Bikes will not be held responsible for any damage to persons or property caused by the battery charger or charging process.

HEREBY WAIVE AND RELEASE indemnity, hold harmless, and forever discharge Buzzed Up E Bikes and its agents, employees, officers, directors, affiliates, successors, and assigns, coaches, teachers, and trustees from any and all claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages, and liabilities of every kind of nature, whether known or unknown, in law or equity, that I ever had or may have, arising from or in any way related to participation in any of the events or activities conducted by, on the premises of, or for the benefit of, Buzzed Up E Bikes, provided that this waiver of liability does not apply to any acts of gross negligence, or intentional, willful, or wanton misconduct.

Limitation of Liability

Buzzed Up E Bikes shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, data, or use, arising out of or related to the use of our products or services, even if advised of the possibility of such damages. Our liability is strictly limited to the purchase price of the product.

Force Majeure

Buzzed Up E Bikes shall not be responsible for any delays or failure to fulfill our obligations due to causes beyond our control, including but not limited to acts of God, natural disasters, strikes, or interruptions in transportation services. In such cases, our obligations will be suspended for the duration of the event.

Warranty Disclaimer

Buzzed Up E Bikes provides a warranty for defects in materials and workmanship under normal use and maintenance, as outlined in our warranty policy. The warranty does not cover normal wear and tear, damage caused by misuse, improper assembly, or unauthorized modifications. Please refer to our warranty section for full details.

Dispute Resolution

Any disputes arising from the use of our products or services shall be resolved through good-faith negotiations. If a resolution cannot be reached, the dispute shall be settled through binding arbitration in Queensland, in accordance with the rules of the Australian Centre for International Commercial Arbitration. Each party will bear its own costs in the arbitration process.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Queensland, Australia. Any legal action or proceeding arising out of or relating to these terms shall be brought exclusively in the courts located in Queensland.

Intellectual Property

All content, logos, trademarks, and other intellectual property displayed on the Buzzed Up E Bikes website are the property of Buzzed Up E Bikes. You may not use, reproduce, or distribute any of our intellectual property without prior written consent.

Updates to Terms and Conditions

Buzzed Up E Bikes reserves the right to update or modify these Terms and Conditions at any time without prior notice. The most current version of the terms will be available on our website, and it is the customer’s responsibility to review them regularly.
